Terms & Conditions
Clear terms for individuals and organisations using LoughPoint.
Current service notice: customer online payments are not enabled. These policies describe the present service and will be reviewed before commercial launch.
1. Who we are and these terms
LoughPoint is operated by LOUGHPOINT LTD, registered in Northern Ireland, company number NI744495. Our registered office is Forsyth House, Cromac Square, Belfast, Northern Ireland, BT2 8LA. Contact legal@loughpoint.com about these terms and complaints@loughpoint.com about complaints. VAT registration is pending.
These terms cover our website and workforce-planning tools. They apply to individuals and business customers. You are a consumer if you act wholly or mainly outside your trade, business, craft or profession. If you act for an organisation, you must have authority to do so. Mandatory consumer rights take priority over any conflicting provision.
2. Current service and access
LoughPoint provides forecasts, staffing calculations, costing and scenario tools. Public samples are available without signing in. Customer-file workspaces require an active access grant. Sign-in uses Supabase email codes; there is no separate LoughPoint password. Owner access also requires an authenticator. Email recovery is handled by your email provider; authenticator recovery requires your saved setup key or verified support.
Customer online payments are not enabled. An access code does not create a paid subscription or automatic renewal. Access codes must normally be redeemed within seven days and give one calendar month from redemption, subject to the access details shown in your account. Existing plan labels do not yet enforce separate feature packages. Owner-only payment sandbox tests do not grant paid access.
Displayed plans are information about the proposed commercial service. A paid contract requires a separately confirmed order identifying the service, total price, term, renewal and cancellation arrangements. These terms do not activate billing or change any existing agreed price or access grant. For routine refund or billing enquiries, contact refunds@loughpoint.com. See our Refund & Cancellation Policy for eligibility and cancellation rights.
3. Using the tools responsibly
Use the service lawfully and follow our Acceptable Use Policy. Keep your sign-in account and access codes secure. Tell us if you suspect misuse. You retain ownership of your input data and outputs and must have the rights and authority to use the data you provide.
Planning results depend on your data, assumptions and the method selected. Review inputs, methodology and outputs before making staffing, employment or financial decisions. Results are estimates, not guaranteed outcomes or professional advice. We will provide the service with reasonable care and skill; these explanations do not exclude that obligation.
Planning files are processed in your browser in the current application. Optional recovery saves a project copy in this browser on this device; downloaded project copies are separate files you control. Browser storage can be cleared or become unavailable, so keep a downloaded copy of important work. LoughPoint is not a backup service. These limitations do not remove our duty to use reasonable care and skill. Do not put personal customer records, credentials or sensitive data in support messages; use aggregated or synthetic examples.
4. Intellectual property
We and our licensors retain rights in the website, software, branding and documentation. Your access permits use of the available tools and your outputs for lawful personal or business planning. It does not transfer ownership of our software or branding. Statutory rights and applicable open-source licences are unaffected.
5. Availability, changes and ending access
We may maintain or update the service and may restrict access where reasonably necessary for security, unlawful use or a material breach. Where practicable we will explain the reason and allow you to address it; urgent protection may require immediate action. You may ask us to review a restriction through complaints@loughpoint.com.
We do not promise uninterrupted availability. We will give reasonable notice of material changes or withdrawal where practicable, and honour applicable contractual and consumer remedies. Changes to these terms apply prospectively and cannot retrospectively remove accrued rights. Material changes to an existing paid contract require appropriate notice and any consent required by law.
You can stop using the free service at any time or contact us to close account access. Closing access is not automatic personal-data deletion and does not itself cancel a separately agreed payment arrangement. See our Privacy Policy and Refund & Cancellation Policy.
6. Responsibility and consumer protection
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or statutory right that cannot lawfully be excluded or limited.
For consumers, we remain responsible for foreseeable loss and damage caused by our breach or failure to use reasonable care and skill. Your rights concerning services and digital content, including applicable repeat-performance, price-reduction, repair, replacement or refund remedies, are preserved. No general “no refunds” rule applies.
For business customers, responsibility for a paid engagement may be set out in a separately agreed business contract, subject to applicable law. These website terms do not introduce a blanket exclusion or monetary cap on liability.
7. Complaints and applicable law
Send complaints to complaints@loughpoint.com with the relevant account email, a description and the outcome you seek. You can also write to our registered office. Do not send passwords or payment-card details. We will review and respond; no fixed support response time is promised. Your right to contact a regulator or bring legal proceedings is unaffected.
These terms are governed by Northern Ireland law. For business contracts, the courts of Northern Ireland have jurisdiction unless a separate written agreement provides otherwise. Consumers retain the protection of mandatory laws and the right to use courts available to them under applicable law, including the courts where they live when entitled to do so.
